Notice of Privacy Practices

Let’s Stream, LLC Notice of Privacy Practices

Updated: June 27, 2020

At Let’s Stream, maintaining the trust of our users is of the utmost importance to us. We have developed this Notice of Privacy Practices (our “Privacy Notice”) to show our commitment to fair information practices and the protection of our users’ privacy, and to explain how we collect, use, share, and disclose information about our users.

Let’s Stream, by leveraging leading third-party video, streaming, payment and other interactive and ecommerce technologies, has developed a live-streaming, digital performance, ecommerce and interactive platform (the “Platform”) from which users can watch and participate in concerts, performances, and other live events (“Events”) streamed using the Platform and presented by those performing artists (the “Artists”) who have chosen to use the Platform to present their Events. This Privacy Notice is being provided to explain the ways in which Let’s Stream collects both personally-identifiable information and certain other anonymous technical or transactional data from its users, the ways in which the collected information is used by Let’s Stream for its own internal purposes, and the ways in which Let’s Stream may share that information with Artists and Let’s Stream’s other business partners.

In general, Let’s Stream will use personal and other personally identifying information that it collects from or about its users (“Personal Information”) so that Let’s Stream can operate its business, provide the Platform and Events, support the Platform and its other products and services, and execute transactions for its users or on their behalf. Fundamentally, Let’s Stream does not and will not provide Personal Information about its users to any third parties not having a legitimate need for that information in connection with Let’s Stream’s business and the operation of its Platform, unless Let’s Stream has a user’s permission or other legal authorization to share that information. In addition, for the avoidance of doubt, the uses of Personal Information described herein will not apply to any deidentified information or any aggregate consumer information (as defined by applicable law) that may be derived from or based on the Personal Information.

This Privacy Notice does not apply to any information that you provide to third parties, or that third parties may collect from you when you use the Platform, including, for clarity, any such information that you may share with an Artist or other users via any chat or similar function available on the Platform. The Platform may allow you to access third-party websites, stores, products and services, and it will be your responsibility to read and confirm your agreement with the privacy policies and practices of those third parties before you provide any information to those third parties. By using the Platform and making or authorizing us to make purchases or execute other transactions on your behalf, you are confirming your receipt and understanding of this Privacy Notice, and your agreement to all of our information practices described herein.

Collection and Use of Personal Information

When you use the Platform to watch or otherwise participate in Events, we will identify you by the user name you have chosen, or that we assigned to you (if you did not select your own user name as part of the registration process or from your profile page after you registered), and we will use your Personal Information to determine your user name. Users must have an active and validly created account in order to use the Platform and participate in Events. In order to buy tickets to Events, tip Artists during events, or engage in other transactions using the Platform, you will need to be a registered user, and it is your responsibility to protect your account and make sure that no one else has access to your password or uses your Let’s Stream account.

Let’s Stream user accounts can be created on our website, from web pages connected to Events that the Platform will be providing, or possibly from within third-party websites or apps that offer access to Events. To create an account, a user must provide Let’s Build with their full (first and last) name, a working mobile phone number, and a valid email address, and must choose a password for their account (all of the foregoing, collectively, the “Basic Account Info”); from there, users wishing to purchase tickets to Events or to add to their Sequin balance (as defined and described in more detail in the Platform Terms of Use, which users must accept in order to create their accounts) will be required to provide credit card information or another acceptable means of payment (as identified on the applicable purchase page).

Let’s Stream may also collect and use technological identifier information – such as computer or mobile device type, operating system type and version, and connection information, as well as usage and traffic data –that is not specifically identified as relating to a particular user or otherwise personally identifiable, to improve the products and services that Let’s Stream offers. This information may also be shared with our business partners, but without any reference to personal identifiers and only on an aggregated and anonymized basis.

Personal Information collected by Let’s Stream may also be used in the following ways:

  • Account Access: A user’s email and password are used to validate their identity on login; the user’s email or mobile phone number can also be used to respond to a user’s request for a “reset password” link.
  • Purchases: A user’s name, address and credit card information will be used when required (and authorized by the user) to make payments for purchases via the Platform.
  • Email Offers: A user who has not opted out may be notified by email of special offers, improvements and other changes to the Platform or to Let’s Stream ’s business, and may receive promotional messages, newsletters, marketing and other information (which may include information about Let’s Stream’s affiliates’ and partners’ campaigns and services) potentially of interest based on the user’s stated communication preferences.
  • Other Notices: User emails or mobile phone numbers may be used to provide notice of changes to this Privacy Notice or to the Platform’s Terms of Use, or to any other terms or agreement applicable to the Platform, to contact users about their use of the Platform, or to reply to any support issues or other questions.

Additional Information

Let’s Stream may disclose your Personal Information if we determine that we are required to do so:

  • To comply with applicable laws, or with legal process served on us;
  • To protect or defend our rights or the rights of any of our users or business partners;
  • To enforce our terms of use or other agreements with users; or
  • To protect anyone’s rights, property or safety.

Let’s Stream may share your information with Artists and with its business partners (including, without limitation, business partners that may represent or otherwise provide the services of one or more Artists) when you participate in an Artist’s Event or in any Event that is produced or promoted by a Let’s Stream business partner; provided, that Let’s Stream will identify (in an Event’s promotional materials or on the registration page for an Event) any Event that is being produced or promoted by a third-party, or that will otherwise include the sharing of your personal information with the Artist or with any third-party representative of the Artist. For clarity, any information that you choose to share via a chat or messaging function or any other public forum during or in connection with an Event will not be subject to this Privacy Notice and may be visible to an Artist as well as to one or more of the other users participating in the Event; as a result, you should always exercise extreme care before sharing any Personal Information in any chat or message window or via any public forum, as the protections of this Privacy Notice will not apply to that information.

Let’s Stream may also share your Personal Information with any third-party that purchases, or to which we transfer, all or substantially all of our assets and business. Should such a sale or transfer occur, we will use reasonable efforts to try to ensure that the entity to which we transfer your Personal Information uses it in a manner that is consistent with this Privacy Notice.

From time to time, Let’s Stream may use the standard “cookies” feature of major browser applications (or similar features in mobile apps), which allows Let’s Stream to store a small piece of data on a user’s computer or mobile device about their use of the Platform and Let’s Stream’s products and services. Cookies may help Let’s Stream to understand which aspects of our products and services are useful and which aspects may need improvement. The cookies that Let’s Stream uses are sometimes called “first-party cookies,” and there are two varieties of first-party cookies – session cookies and persistent cookies. A session cookie is stored in temporary memory on a device, is not retained after a user’s browsing session ends and does not collect information from the user’s device. A persistent cookie remains in the browser’s sub-folder after the user closes their browser, is activated again once the user visits the online location that created the particular cookie, and remains for the duration period set within the cookie’s file. Users can review their web browser “Help” file to learn how to modify cookie settings; if, however, a user deletes, or chooses not to accept, cookies from Let’s Stream, that user may not be able to use the features of the Platform or other Let’s Stream products and services to their fullest potential. Promotions, advertisements or other third-party content displayed on the Platform and Let’s Stream’s other products and services may also contain cookies, and Let’s Stream does not have access to or control over information collected by outside advertisers when a user clicks on any such promotions or advertisements.

“Do Not Track” Feature Not Available

Let’s Stream understands that some users may have enabled a “do not track” feature or other mechanism intended to provide consumers with a choice regarding the collection of their personally identifiable information; however, consistent with and to the maximum extent permitted by Let’s Stream’s rights under applicable law, Let’s Stream does not respond to any such "do not track" requests or other signals sent from a web browser.

Notice Concerning Children

The Platform and the Events are not intended for children under the age of 13. Therefore, Let’s Stream does not knowingly collect Personal Information via the Platform or Let’s Stream’s website from anyone under 13. Any user that believes that Let’s Stream has in its database the personal information of a child under the age of 13 should contact Let’s Stream at[email protected] or by mail at

Information Security and Storage

Let’s Stream has implemented technical and organizational measures to provide a level of security appropriate to the risk to the Personal Information that Let’s Stream processes. These measures are aimed at preserving the ongoing integrity and protecting the confidentiality of users’ Personal Information. Let’s Stream evaluates these measures on a regular basis to confirm that it continues to maintain and apply an appropriate level of security.

We will keep your Personal Information for as long as we have a relationship with you, and for as long as is necessary to maintain our products and services thereafter. We will delete data as it becomes unnecessary to retain it for these purposes, except that we will subsequently retain your Personal Information after this time only if we are required to do so to comply with the law, or if there are outstanding claims or complaints that will reasonably require your Personal Information to be retained.

International Data Transfers

Because the Platform makes Events available on a global basis, with users located in many countries around the world, a user’s Personal Information may be transferred to, stored in, or processed in a country with privacy laws, rules and regulations that are different than the laws, rules and regulations in the country where the user resides, which may include countries for which there has not been an “adequacy decision” or other determination by a governing authority that such countries provide an adequate level of protection for personal information. Let’s Stream will not transfer personal information to any country that has not covered by an adequacy decision or similar determination regarding the country’s protection of personal information without first determining that the transfer can be made subject to adequate safeguards, and that Personal Information will be protected in accordance with prevailing international standards.

Changes to this Privacy Notice

We may revise this Privacy Notice from time to time — e.g., to keep up with changes in the law, or to reflect changes in how we are doing business — and so you should review this Privacy Notice periodically to make sure you are ok with our current privacy practices.

If we change this Privacy Notice, we will notify you that there have been changes. The Let’s Stream website and Platform home page will always include our most up-to-date Privacy Notice, and we include an effective date at the top of the Privacy Notice, so you can quickly see when we last updated it.

Where changes to this Privacy Notice will have a fundamental impact on the nature of the processing or otherwise may have a substantial impact on you, we will give you sufficient advance notice so that you have the opportunity to exercise your rights.
